These Terms of Service ("Terms") govern your access to and use of Notedger (the "Service"), a web-based note and reporting application. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Notedger is a tool that allows users to create dated, timestamped entries for individual situations, each with notes, a photo, a title, and a summary, and to generate a standalone report from any entry. The Service is provided as a general-purpose record-keeping tool for personal, household, or business use; it is not a substitute for professional, legal, or medical advice.
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at kevin.kubitskey@gmail.com if you suspect unauthorized use of your account.
The Service is offered on a subscription basis at the following rates:
Subscriptions are processed through Stripe, a third-party payment processor. By subscribing, you authorize recurring charges to your chosen payment method until you cancel. Subscriptions renew automatically at the end of each billing period unless canceled prior to the renewal date. To cancel, contact kevin.kubitskey@gmail.com; cancellation takes effect at the end of the then-current billing period. Fees already paid are non-refundable except where required by law.
You agree to use the Service only for lawful purposes. You agree not to:
You are solely responsible for ensuring your use of the Service, including any information, photos, or entries you log, complies with all applicable federal, state, and local law.
The Service timestamps entries using your device's system clock and any location or metadata your device provides. Accuracy depends on your device, its settings, and prevailing conditions, and is not guaranteed. Notedger makes no representation that entries or reports generated by the Service will be admissible or accepted in any court, hearing, workplace proceeding, insurance claim, or other formal process. You are responsible for independently verifying the accuracy of any entry and for confirming any requirements that apply to your specific situation before relying on an exported report.
The Service, including its software, design, and content (excluding your own entries and data), is protected by applicable intellectual property laws. You retain ownership of the data and entries you create using the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA LOSS WILL NOT OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTEDGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time. Upon termination, your right to access the Service ends; provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 9, and 12.
We may update these Terms from time to time. Material changes will be communicated by posting an updated version with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Pima County, Arizona.
